ஈழத்தில் நடத்தப்பட்ட திட்டமிட்ட இனப்படுகொலைக்குத் தலையீடற்ற பன்னாட்டு விசாரணையை மேற்கொள்ள ஐ.நா மன்றத்தில் உலக நாடுகள் அழுத்தம் கொடுக்க வேண்டும்! – சீமான் வலியுறுத்தல்
உலக நாடுகளின் துணையோடு சிங்களப் பேரினவாத அரசால் திட்டமிட்டு நிகழ்த்தப்பட்ட மாபெரும் இன அழிப்பு நடவடிக்கையான ஈழ இனப்படுகொலைக்கு நீதிகோரி பத்தாண்டுகளுக்கும் மேலாக உலகத்தமிழினம் சர்வதேச அரங்கில் பல்வேறு போராட்டங்களை முன்னெடுத்து கூக்குரலிட்டு வரும் நிலையில் இதுவரை எவ்வித நீதியும் கிடைக்காத தற்காலத்தில், கடந்த மாதம் சனவரி 27 அன்று இலங்கை மீது ஐ.நா. மனித உரிமைகள் பேரவை உயராணையர் மிச்செல் பச்லெட் ஜெரியா அவர்கள் வெளியிட்டுள்ள அறிக்கை பெரும் நம்பிக்கையையும், ஆறுதலையும் தருகிறது. 2009 ஆம் ஆண்டு முதல் நாம் வலியுறுத்தி வந்த இலங்கைக்குள் ஒருபோதும் இனப்படுகொலைக்கான நீதியைப் பெறமுடியாது என்ற உண்மையை இத்தனை ஆண்டுக்காலத் தாமதத்திற்குப் பிறகு, ஐ.நா. மனித உரிமைகள் பேரவை உணர்ந்து, நேர்மையாக அதனை ஒப்புக்கொண்டு வெளிப்படையாக அறிவித்துள்ளதை முழுமையாக வரவேற்கிறேன்.
இனப்படுகொலைக்குப் பிறகான, கடந்த பன்னிரெண்டாண்டுகளில் சிங்களப் பேரினவாத அரசாங்கத்தால் தமிழ் மக்கள் மீது தொடர்ந்து ஏவப்படும் இனவெறி அடக்குமுறைகளைக் கூர்மையாகக் கவனித்து மிக விரிவாக, தக்க ஆதாரங்களுடன் பட்டியலிட்டுள்ள ஐ.நா. மனித உரிமைகள் பேரவையின் முன்னெடுப்பு காலத்திற்கேற்ற சாலச் சிறந்த நடவடிக்கையாகும். அதன்படி, கடந்த 2015 ஆம் ஆண்டு முந்தைய சிறிசேனா அரசாங்கம் ஒப்புக்கொண்ட 30(1) விசாரணை ஆணையத்திலிருந்து ஐ.நா. அவையை அவமதிக்கும் வகையில் தன்னிச்சையாக இலங்கை வெளியேறியது, ஐ.நா. மனித உரிமை அதிகாரிக்கே விசா தர மறுத்தது, வடக்கு – கிழக்கு நிலங்களை முழுக்க முழுக்க இராணுவமயமாக்கி திறந்தவெளி சிறைச்சாலை கைதிகளைப் போலத் தமிழர்களை வைத்திருப்பது, 20வது அரசியலமைப்புச் சட்டத்திருத்தம் கொண்டுவந்து நீதிமன்றம் மற்றும் நாடாளுமன்றத்தின் அதிகாரங்களைக் குறைத்து இராணுவம் மற்றும் அதிபரின் அதிகாரங்களை அதிகரிப்பது, தமிழர் பகுதிகளில் அத்துமீறிய சிங்களக் குடியேற்றங்களை வலிந்து திணிப்பது, தமிழ் மக்களுக்குச் சொந்தமான காணிகளை அபகரிப்பது, தமிழர் வழிபாட்டுத்தலங்களைச் சிதைத்தழிப்பது, சிறுபான்மை மக்களின் மத மற்றும் பண்பாட்டு உரிமைகளை மறுப்பது, தேசிய கீதத்தைத் தமிழில் பாடத் தடைவிதித்திருப்பது, கொரோனா பெருந்தொற்றுக்காலத்தில் கூட தமிழ் அரசியல் கைதிகளை மட்டும் விடுவிக்காமல் சிறையிலேயே சாகடித்தது, தீவிரவாத தடைச்சட்டம் என்ற பெயரில் தன்னார்வத் தொண்டு நிறுவனங்கள், மனித உரிமை ஆர்வலர்கள் மற்றும் ஊடகவியலாளர்கள் செயல்பாட்டை அச்சுறுத்தி முடக்குவது என அவை இலங்கை அரசின் தொடர்ச்சியான இனவெறிச் செயல்பாட்டைப் பட்டியலிட்டுள்ளன.
மேலும், இராணுவப் பாதுகாப்புடன் போலியான தொல்லியல் ஆராய்ச்சி நடத்தி பூர்வகுடி தமிழர் நிலங்களை சிங்கள வாழ்விடமாகக் கட்டமைத்து அங்கு புத்தர் சிலை மற்றும் விகார்களை நிறுவுவது, இறந்த இசுலாமிய மக்கள் உடல்களைப் புதைக்கவிடாமல் எரித்தது, தமிழர்களுக்குக் குறைந்தபட்ச அதிகாரம் வழங்கும் 13வது சட்டத்திருத்தத்தையும் நீர்த்துப்போகச் செய்ய முயல்வது, சுதந்திர தினம் உள்ளிட்ட அரச உரைகளில் பெரும்பான்மை சிங்கள மக்களைக் கவரும் வகையில், சிறுபான்மை மக்கள் மீது வெறுப்பையும், விரோதத்தையும் தூண்டும் வகையிலான இனவெறி பேச்சுக்களைப் பேசுவது, இனப்படுகொலையில் பங்கேற்ற சவேந்திர சில்வா போன்ற இராணுவ அதிகாரிகளை அரசின் மிக உயர் பதவிகளில் அமர்த்துவது, தமிழர்களை அடிமைகளாக நடத்தும் வகையில் அரசியலைப்புச்சட்டத்தையே புதிதாக வடிவமைக்க முயல்வது என இலங்கை அரசாங்கத்தின் தமிழின அழித்தொழிப்புச் செயல்திட்டங்களை அடுக்கடுக்கான ஆதாரங்களுடன் ஐ.நா. மனித உரிமை பேரவை ஆணித்தரமாக முன்வைத்துள்ளது.
இனப்படுகொலையில் உயிரிழந்த உறவுகளுக்கு நினைவேந்தல்கூட நிகழ்த்தமுடியாதபடி நினைவிடங்களை இடித்துத் தரைமட்டமாக்கும் வகையில் அண்மைக்காலத்தில் சிங்கள இனவெறி அரசின் அட்டூழிய நடவடிக்கைகள் உச்சத்தை அடைந்துள்ளன. அதனை உறுதிபடுத்தும் வகையில் ஐ.நா. மன்றத்தில் முன்னாள் உயர் ஆணையரான அம்மையார் நவநீதம் பிள்ளை, “இலங்கை மீதான ஐ.நா. மனித உரிமை பேரவையின் தனது வழக்கமான பார்வையை முற்றாக மாற்றவேண்டிய தருணமிது” என்று தெரிவித்தார். அதனடிப்படையிலும், எழுபது ஆண்டுகாலமாக சிங்கள பேரினவாதத்திற்கெதிராக ஓயாது ஒலித்துக்கொண்டிருக்கும் தமிழர்களின் உரிமைக்குரலின் வெளிப்பாடாகவுமே ஐ.நா. மனித உரிமை பேரவையின் அறிக்கை அமைந்துள்ளதென்றால், மிகையல்ல! கண்ணுக்கெட்டிய தூரம் வரையில் ஈழ இனப்படுகொலைக்கு நீதி கிடைக்காது இருள் சூழ்ந்திருந்தவேளையில் ஐ.நா. மனித உரிமைகள் பேரவையின் அறிக்கை சிறு வெளிச்சத்தைக் காட்டியுள்ளது. எனவே, இதன் பிறகாவது உலக நாடுகள் தங்களது அறம் தவறிய அமைதியைக் கலைத்து மனிதநேயத்துடன் இனப்படுகொலைக்கு ஆளான தமிழினத்திற்கு நீதியைப் பெற்றுத்தர முன்வரவேண்டும் என உலகத் தமிழர்களின் சார்பாகக் கேட்டுக் கொள்கிறேன்.
வரும் பிப்ரவரி 22ஆம் நாள் தொடங்கவுள்ள ஐ.நா. மனித உரிமை பேரவையின் 46ஆவது கூட்டத்தொடரில், ஐ.நா. மனித உரிமை ஆணையர் அறிக்கையில் கூறியுள்ளபடி, இனப்படுகொலை குற்ற ஆதாரங்களைத் திரட்டி ஆவணப்படுத்த பன்னாட்டு பொறிமுறையை ஏற்படுத்தவும், இலங்கை அரசால் தமிழர்களுக்கெதிராக நடத்தப்பட்ட உள்நாட்டுப்போரின் கொடும் குற்றங்களைச் சர்வதேச குற்றவியல் நீதிமன்றத்தில் விசாரிக்கவும், இனப்படுகொலையில் பங்கெடுத்த இலங்கை இராணுவ அதிகாரிகளுக்குப் பன்னாட்டளவில் தடை விதிக்கவும், தண்டனை வழங்கவும், இனப்படுகொலை குற்றவாளிகளைப் பன்னாட்டு நீதிமன்றத்தின் முன் நிறுத்தவும் உலக நாடுகள் துணை நிற்க வேண்டும் என அறைகூவல் விடுக்கிறேன்.
2013 ஆம் ஆண்டு மார்ச் மாதத்தில் ஐ.நா. மனித உரிமைப் பேரவையில் சர்வதேச விசாரணைக்கு இலங்கையை உட்படுத்த வேண்டுமென அமெரிக்கா கொண்டுவந்த தீர்மானத்தை நீர்த்துப் போகச் செய்தது திமுக அங்கம் வகித்த காங்கிரசு தலைமையிலான மத்திய அரசு. அன்றைக்கு பாகிஸ்தான் மற்றும் சீனாவுடன் சேர்ந்து தமிழர்களுக்கு எதிராக ஐக்கிய முற்போக்கு கூட்டணி அரசாங்கம் செய்த அதே பச்சைத்துரோகத்தை தற்போது மத்தியில் ஆளும் பாஜக அரசு செய்துவிடக்கூடாது. தமிழினத்திற்கு அணுவளவாது ஏதேனும் நன்மைகள் செய்ய வேண்டும் என்று பாஜக அரசு உண்மையிலேயே அக்கறை கொண்டிருக்குமாயின், இனப்படுகொலை செய்த இலங்கையைப் பன்னாட்டுக் குற்றவியல் நீதிமன்றத்தின் முன் விசாரிக்கும்படி தீர்மானத்தை முன்மொழிந்து அதற்கு உலக நாடுகளின் ஆதரவைப் பெற்று நிறைவேற்றச் செய்ய வேண்டும். அதுதான் உலகத் தமிழர்களின் ஒருமித்த விருப்பம் என்பதை தமிழகச் சட்டமன்றத்தில் இயற்றப்பட்ட தீர்மானமே பறைசாற்றும். ஆகவே, இந்த ஆண்டு ஐ.நா. மனித உரிமை பேரவையில் இந்தியாவுக்குக் கிடைத்துள்ள உறுப்பினர் இருக்கையைப் பயன்படுத்தி இலங்கை அரசைப் பன்னாட்டுக் குற்றவியல் நீதிமன்றத்தில் நிறுத்த வல்லாதிக்க நாடுகளின் ஆதரவுடன் நடவடிக்கை எடுக்க வேண்டும்.
இனப்படுகொலைக்கு ஆளான ஈழத்தமிழ் உறவுகளுக்கு நீதியைப் பெற்றுத்தரக் கிடைத்திருக்கும் இவ்வரிய வாய்ப்பினை எட்டுகோடித் தமிழர்கள் வாழும் நிலமான தமிழகத்தின் ஆட்சி அதிகாரத்தில் அமர்ந்திருக்கும் அதிமுக அரசு தவறவிடக்கூடாது. கடந்த 2013 மற்றும் 2015 ஆம் ஆண்டுகளில் அன்றைய முதலமைச்சர் அம்மையார் ஜெயலலிதா அவர்கள் இனப்படுகொலை நிகழ்த்திய இலங்கைப் பேரினவாத அரசு மீது பன்னாட்டு விசாரணை நடத்த ஐ.நா. மனித உரிமைக் பேரவையில் இந்தியா தீர்மானத்தை முன்மொழிய வேண்டுமென்று, அன்றைக்கு மத்திய அரசை வலியுறுத்தி தமிழ்நாடு சட்டமன்றத்தில் தீர்மானம் நிறைவேற்றியதை மனதிற்கொண்டு, அவரது வழியில் செயல்படுவதாகக் கூறும் தமிழக முதலமைச்சர் ஐயா எடப்பாடி பழனிச்சாமி அவர்கள் உடனடியாகச் சட்டமன்றத்தைக் கூட்டி ஐ.நா. மனித உரிமை உயராணையர் அறிக்கையில் அதிகாரப்பூர்வமாக முன்வைக்கப்பட்டுள்ள ஈழ இனப்படுகொலைக்கு நீதியைப் பெறுவதற்கான செயல்முறைகளை நடைமுறைப்படுத்தும் தீர்மானத்தை இந்தியாவே முன்மொழிய வேண்டுமெனத் தீர்மானம் நிறைவேற்ற முன்வர வேண்டும். அத்தீர்மானத்தின் மூலம் மத்தியில் ஆளும் பாஜக அரசிற்கு அரசியல் அழுத்தம் கொடுக்க வேண்டும். மேலும், இவ்விவகாரத்தில் தமிழகத்திலுள்ள அனைத்து அரசியல் கட்சிகளும், இயக்கங்களும், அமைப்புகளும் ஒருமனதாக இந்நடவடிக்கைக்கு ஆதரவளிக்க வேண்டும். ஈழத்தமிழர் அரசியல் கட்சிகள் அனைத்தும் ஒன்றுபட்டு இதே கோரிக்கையை ஐ.நா. மனித உரிமைப் பேரவையின் 47 உறுப்பு நாடுகளுக்கும் கடிதம் எழுதியுள்ளனர். அதே போன்று, இலங்கை மீது பன்னாட்டு விசாரணை பொறிமுறை கோரி பிரான்ஸ், அமெரிக்கா, இங்கிலாந்து, ஜெர்மனி, கனடா, ஆஸ்திரேலியா உள்ளிட்ட நாடுகளின் நாடாளுமன்ற உறுப்பினர்கள் அவரவர் நாடுகளின் அரசிடம் முன்வைத்துள்ளனர். ஆகவே, வரலாறு தந்திருக்கும் இவ்வாய்ப்பினை உலகத்தமிழினம் தவறவிடக்கூடாது. உலகெங்குமிருக்கும் புலம்பெயர் தமிழர்கள் தாங்கள் வாழும் நாடுகளின் அரசாங்கத்தை இலங்கைக்கு எதிரான தீர்மானத்தை ஆதரிக்க வலியுறுத்தி தொடர்ப்போராட்டங்களை அறவழியில் முன்னெடுக்க வேண்டும்.
இனப்படுகொலை நிகழ்ந்து இத்தனை ஆண்டுகளில் இலங்கைப் பேரினவாத அரசு உள்நாட்டு விசாரணை என்ற பெயரில் வெறும் கண்துடைப்பு நாடகம் நடத்துவதும், கொலைக்குற்றவாளியையே நீதி விசாரணை செய்ய அனுமதிப்பதும் எவ்வளவு மோசமான விளைவுகளை ஏற்படுத்தும் என்பதை ஐ.நா. மனித உரிமை ஆணையர் அறிக்கை தெளிவாக எடுத்துரைத்துள்ளது. ஆகவே, உலக நாடுகள் தத்தம் வர்த்தக மற்றும் பிராந்திய நட்புறவினை கடந்து, அறத்தின் பக்கம் நின்று தமிழினத்தின் படுகொலைக்கு உரிய நீதியைப் பெற்றுத்தரவேண்டும். தமிழர்கள் தங்கள் இனப்படுகொலைக்கு நீதிகேட்கும் இந்த நெடியப் போராட்டத்தில் நட்பு நாடு என்று கூறி இந்திய அரசு இலங்கைக்கு ஆதரவாக நின்று தமிழர்களை வஞ்சித்து மீண்டுமொருமுறை வரலாற்றுப் பெருந்துரோகத்தைச் செய்துவிடக்கூடாது எனவும், மத்திய அரசு விரைந்து உரிய நடவடிக்கை எடுக்க தமிழக அரசும் உடனடியாக வலியுறுத்த வேண்டுமெனவும் நாம் தமிழர் கட்சி சார்பாகக் கேட்டுக்கொள்கிறேன்.

Set up International Judicial Mechanism to Probe into Thamizh Genocide Perpetrated by Sri Lanka! Seeman Calls World Nations!
For more than a decade, the Thamizhs across the globe have been registering various protests in the international arena to demand justice for the Thamizh Genocide planned and carried out by the Sinhala chauvinist government with the support of a few world nations. The statement issued by the High Commissioner of the Human Rights Council, Michelle Bachelet Jeria, gives great hope and comfort. After all these years of delay, the UN has come to terms with the fact that justice can never be achieved when Sri Lanka, the perpetrator of the Thamizh Genocide, conducts its own investigation, which we have been emphasizing since 2009. I wholeheartedly welcome the fact that the Human Rights Council has realized, sincerely acknowledged, and openly declared it.
The UN has closely monitored the racist repression perpetrated on the Thamizhs by the Sinhala chauvinist government over the past twelve years in the aftermath of the genocide. The Human Rights Council has now taken up a credible and best initiative. The Human Rights Council resolution 30/1, which was accepted by the then Sri Lankan government under Sirisena in 2015, the government headed by the Rajapaksha once again had voluntarily withdrawn in defiance, thereby insulting the UN. There is a list of racist activities by the Sri Lankan government. They are as follows: The denial of visa to human rights officer, the complete militarization of the Thamizhs dominant north-eastern provinces of Sri Lanka, thereby treating Thamizhs as prisoners, the Amendment of the 20th Constitution to reduce the powers of the Thamizhs dominant north-eastern provinces’ judiciary and parliament, increase the powers of the military and the president, forcible encroachment by the Sinhala in Thamizh areas, and seize land owned by Thamizh people. Demolition of Thamizh places of worship, denial of religious and cultural rights of minorities, ban on singing the national anthem in Thamizh, not releasing the Thamizh political prisoners alone even during the COVID-19 Crisis period, in the name of banning extremism, threatening the voluntary organizations, human rights activists, and the journalists, thereby hindering them in carrying out their activities.
Furthermore, conducting pseudo-archeological research with military protection, forming Sinhala settlements in the indigenous Thamizh lands, erecting Buddha statues and shrines there, forcefully cremating bodies against Muslim rites, i.e., without burial, and attempting to dilute the 13th Amendment, which gives minimum powers to Thamizhs, derogatory and hate speeches by the government officials, even during the eve of the Independence Day, on the minorities Thamizh and Muslim people that appeal to the majority Sinhalese population. The UNHRC has strongly stated and listed evidence of the Sri Lankan government’s anti-Thamizh agenda, such as making racist speeches that incite hatred and hostility towards the people, appointing military officials such as Shavendra Silva to high-ranking positions in the state, and trying to amend the constitution to enslave Thamizhs.
The atrocities of the Sinhala racist state have reached a new level in recent years, The demolition of monuments for the commemoration of the victims of the genocide is a classic example. Referring to the civilian killings in 2009, the Former UN officials, including Navaneetham Pillai, Former High Commissioner, and international experts call for immediate action in their joint statement stating that “In 2009 the international community failed Sri Lanka. We must not fail again”. The latest 46th Session Report of the United Nations High Commissioner for Human Rights has captured 70 years of Thamizhs grievances, their pain, and agony. This report of the Human Rights Council sheds more light on the crux of the Thamizh issue, which will definitely be an eye-opener for the world nations. Therefore, on behalf of the Thamizhs of the world, I call on the world nations to break their silence and come forward to bring justice to the Thamizh genocide perpetrated by Sri Lanka.
The UNHRC’s 46th Session has been scheduled to begin on 22nd February 2021. In this session, as mentioned by the Human Rights Commissioner in her report, the world nations should bring Sri Lanka under the purview of an International Judicial Mechanism, collect and document evidence of genocide, prosecute Sri Lankan military personnel involved in genocide, and bring justice to Thamizhs. In March 2013, The then Congress-led Indian government, of which the DMK was an ally, has watered down the US resolution in the UNHRC calling for Sri Lanka to be subjected to an international investigation. The ruling BJP government have done the same what the then United Progressive Alliance government did against the Tamils. If the BJP government is genuinely interested in the wellbeing of Thamizhs, it should propose a resolution to prosecute Sri Lanka for perpetrating the Thamizh Genocide before an International Judicial Mechanism, with the support of the world community, like the one passed by the Tamilnadu government in the past.
In 2013 and 2015, the then Chief Minister J. Jayalalithaa of AIADMK called on the UN to launch an international investigation into the genocidal Sri Lankan chauvinist government. The current Tamil Nadu Chief Minister Edappadi Palanichami, who follows the footstep of J. Jayalalithaa should propose a similar resolution and pressure the Indian government to put forward a resolution at the UNHRC. Furthermore, all political parties, movements, and organizations in Thamizh Nadu should unanimously support this move in this regard. All the political parties of Thamizh Eezham have written to the 47 member states of the Human Rights Council regarding the same. Similarly, parliamentarians from countries including France, the United States, the United Kingdom, Germany, Canada, and Australia have approached their respective Governments to bring Sri Lanka under International Judicial Mechanism. Therefore, the world community should not miss this opportunity; the Thamizh diaspora should urge the countries where they live to support the resolution against Sri Lanka and carry out peaceful demonstrations.
It is high time that the world nations must transcend “Geopolitics”, stand by virtue, and seek justice for the Thamizh Genocide. On behalf of the Naam Tamilar Party, I urge the Indian Government not to claim Sri Lanka as an ally and deceive Thamizhs again in this protracted struggle for justice for the Thamizh Genocide and urge to take immediate and appropriate action and not commit another historic treacherous act.
